Banks may have to pay off arrears due to their error

The Financial Ombudsman Service (FOS) said yesterday that banks who undercharge mortgage borrowers may in some cases be expected to write off any back debt – but that in others, borrowers may also have had a responsibility not to underpay.

The FOS could not comment on whether there had been a rash of successful complaints about incorrect mortgage payments in the wake of the episode at the Clydesdale and Yorkshire banks which saw 18,000 borrowers sent demands in July for big rises in their mortgage payments.
