It is, of course, a nonsensical position to take in purely logical terms. In effect it is merely to say that if you make something illegal, the people who do it will be acting illegally.

There is an argument often made against new laws or restrictions on behaviour which, in essence, boils down to saying: “There is no point in banning this activity, because all you will do is drive it underground.”
