The jury at the Jean Charles de Menezes inquest resumed its deliberations for a third day yesterday.

Coroner Sir Michael Wright has ruled out unlawful killing, directing the 11 jurors to return either lawful killing or an open verdict.

Mr de Menezes, 27, was shot dead by police marksmen at Stockwell Tube station in south London on July 22 2005 after being mistaken for failed suicide bomber Hussain Osman.

Sir Michael told the jurors to cast aside "any emotion" over the innocent Brazilian's shooting after hearing more than seven weeks of evidence.

He took the unusual step of issuing a "questionnaire" relating to the circumstances surrounding the incident.

The jurors must also decide, among other questions, whether officer C12 shout the words "armed police" at Mr de Menezes before firing and if Mr de Menezes stood up from his seat before he was grabbed in a bear hug by officer Ivor.

The jury will resume its deliberations today.
