Family law experts have welcomed a decision by the Supreme Court in London to reject the appeal of a mother whose child was adopted without her consent.
Proceedings to have the boy, now five, adopted, were begun at Dumbarton Sheriff Court in 2009, without her agreement. Lawyers for the woman had argued her human rights had been breached by the decision.
The case was brought before the Supreme Court – the final court of appeal in the UK for civil cases – on the grounds that adoption orders made without parental consent breached the rights of both parent and child to a family life enshrined in the European Convention on Human Rights (ECHR).
