A HOLIDAY-MAKER who brought back a knuckle duster and baton as souvenirs from his stay on Cyprus had his conviction for possessing offensive weapons overturned by appeal judges.
Bruce Smith was found to have the items in a suitcase at Aberdeen railway station which was searched after he got into an altercation with Scotrail staff.
Smith, 21, was convicted of having offence weapons at the railway station on July 23, 2012, at the city's sheriff court last year and fined £400.
Sheriff Peter Hammond rejected a defence of "reasonable excuse" put forward on Smith's behalf based on him making a journey home, having bought the items abroad. But judges at the Justiciary Appeal Court in Edinburgh have now upheld his legal challenge against the guilty finding in a divided decision.
