THE family of Sheku Bayoh, who died in police custody, are to meet Lord Advocate Frank Mulholland this week as their lawyer attacked claims a report into the case is "at odds" with their account of what happened.

Father-of-two Mr Bayoh, 31, died in custody after an alleged incident in as yet unexplained circumstances involving up to nine officers in Kirkcaldy, Fife.

A female officer was injured in the incident which began at around 7am on Sunday, May 3.

Aamer Anwar, lawyer for the Bayoh family, claims that excessive force was used by police.

He said Mr Bayoh had not been carrying a knife when he was arrested although it is understood a knife was found 10 yards from the scene of the arrest in Hayfield Road.

Mr Anwar said the family was concerned over claims said to be about the interim report by the Police Investigations and Review Commissioner (Pirc) into the case.

He said: "The family will meet with the Lord Advocate this Wednesday.

He added that "the family are right to wonder why" claims were being made publicly about the private report. It was also reported Mr Anwar had not disclosed all available information publicly.

It was claimed a source said the report shows "there was a lot more to the situation than has been claimed".

Mr Anwar said: "On one thing they are right - a great deal of information has not been disclosed on behalf of the family including serious concerns that are being considered now by the Lord Advocate."

A Crown Office spokesman said: “The Lord Advocate is due to have a private meeting with the family of Sheku Bayoh to explain the progress which has been made with the investigation.

“It wouldn’t be appropriate to give any further comment ahead of that meeting.”

Attending the meeting will be Collette Bell, Mr Bayoh's partner, his sister Kadijartu Johnson, brother-in-law Adeyemi Johnson, Lorraine Bell, Ms Bell's mother, and Mr Anwar.

The Pirc was instructed to investigate Mr Bayoh's death and it provided an interim report to the Lord Advocate earlier this month which he has been considering.
