THE MAN convicted of murdering bookkeeper Suzanne Pilley has been given permission to add another ground to his appeal against conviction.

David Gilroy, 50, was told yesterday at the Court of Criminal Appeal in Edinburgh that he can argue the actions of the judge and prosecution lawyers during his trial earlier this year could have caused a miscarriage of justice.

Gilroy, formerly of Silverknowes, Edinburgh, was convicted in April of murdering his 38-year-old former lover. In July 2012 his solicitors lodged an appeal against conviction.

They were given permission to argue police should have told Gilroy he was suspected of a crime when they interviewed him after Suzanne went missing.

His lawyers have now been told they can argue that the judge at Gilroy's trial, Lord Bracadale, also acted wrongly after an unedited report was mistakenly given to the jury.

John Scott, QC, acting for Gilroy in his appeal, argued this action could have prejudiced the jury.
