THE mother of Mark Duggan, whose death sparked nationwide riots after he was fatally shot by police, can challenge the inquest into the killing on the grounds that it was legally flawed.
A judge ruled Pamela Duggan has "an arguable case" that should be heard by the Divisional Court in London. Family members and supporters reacted with shock and anger after an inquest jury concluded at the Royal Courts of Justice in January police acted lawfully when they shot 29-year-old Mr Duggan.
The inquest jury found he was lawfully killed by a police marksman in August 2011 in Tottenham, north London, despite being unarmed when he was shot.
Police officers intercepted the vehicle he was in on the basis of intelligence that he was part of a gang and had collected a gun. Yesterday it was revealed that Mr Justice Mitting has ruled after considering papers in the case that Mrs Duggan can apply for judicial review on the grounds that the coroner's direction to the jury in relation to lawful killing was "arguably inadequate".
