Janice MacNeill agreed to the settlement with the governors of the Donaldson Trust which runs Donaldson's School in Linlithgow, West Lothian ahead of the case reaching a hearing.

She was removed from her post following criticism over the school's handling of complaints in the wake of an earlier sex assault case.

Police Scotland said yesterday that a review of allegations passed on by the school's new principal Laura Battles is "ongoing".

Two staff members were suspended last month and an emergency plan launched by education chiefs.

Police are understood to have been assessing claims of misconduct related to serious sexual offences at the facility, some of which are thought to be historical.

Earlier this year former employee William Docherty, who was a communication support worker, was convicted of sexually assaulting a boy following a party.

He was not suspended until four years after the alarm was first raised.

Docherty was placed on the Sex Offenders' Register and was served with a probation order after his conviction.

A spokeswoman for Donaldson??s School said: ??The governors of Donaldson??s School can confirm that mindful of their obligation to expend charitable funds appropriately, and in recognition of the legal costs in proceeding to Tribunal, a full and final settlement has been reached with the former principal.

"Donaldson??s School now has a new principal in Laura Battles, who has been in post since October.??
