Mr Mallya's Kingfisher Airlines business has suspended flights since the beginning of the month in a dispute with staff.
He has been holding talks with drinks giant Diageo, maker of Johnnie Walker whisky, about buying a stake in Whyte & Mackay, which he owns via the United Spirits business.
