A JUDGE has granted a jury trial in a $20 million (£13m) damages lawsuit against the National Theatre of Scotland (NTS).

Stagehand Jason Makula requested the trial after he was hurt while working on the NTS production of Macbeth starring Alan Cumming on Broadway.

New York District Judge John G Koeltl signed off on the trial last week, despite the NTS strongly denying being at fault for the temporary wall falling on Mr Makula on July 15 last year.

Although Mr Makula was employed by the Jazz at Lincoln Centre – the venue hired to stage the production – he claims the theatre company was liable as it was in charge at the time.

The final motions of the case will not be filed until spring next year.
