HOLYROOD ministers face a tougher legal sanction than their Westminster counterparts on the purdah period which bans announcements during the referendum campaign period, MSPs were told yesterday.

The Referendum Bill Committee questioned legal experts, Professor Tom Mullen of Glasgow University and Professor Neil Walker of Edinburgh University, on the independence referendum Bill and the potential for legal challenges

The issue of purdah was raised. Purdah on Scottish ministers will be enshrined in the Referendum Bill, but there will be no statutory counterpart on UK ministers, only the "gentlemen's agreement" between the two governments.

SNP Stewart Maxwell put it to the professors: "For UK ministers it would be a breach of politics. For Scottish ministers it would be a breach of the law."

Mr Mullen said: "It may be more appropriate if the purdah period was on a statutory basis for both governments."
