The Scottish Ministers hereby give public notice of removal of the property factor named below from the Property Factor Register under section 4(7) of the Property Factors (Scotland) Act 2011: O'NEILL PROPERTY 84 Berkeley Street, Glasgow G3 7DS The date of removal is 21 February 2017 This means the relevant date under section 9(2) of the Property Factors (Scotland) Act 2011 (effect of removal) is 22 February 2017. Accordingly, after
22 February 2017:
- No costs incurred by the property factor in respect of work instructed after 22 February 2017 are recoverable;
- No charge imposed by the property factor which relates to a period after 22 February 2017 is recoverable;
- Homeowners may appoint new property factors (or decide to manage their properties without appointing a property factor) in accordance with the procedures made in relation to such decisions in their title deeds or, as the case may be, the Tenement Management Scheme; and
- The property factor may not lodge a notice of potential liability for costs under section 13(1) of the Tenements (Scotland) Act 2004 (asp 11) in respect of work instructed after 22 February 2017.
