FORMER radio DJ Suzie McGuire's 10-year-old daughter has described how her stepfather attacked her mother after she had been at a fair in their home village.

Millie Ross yesterday told Paisley Sheriff Court that Derek Mitchell, who is the estranged husband of Ms McGuire, bent her mother's finger back after they had attended Eaglesham Fair in East Renfrewshire in 2011.

Mr Mitchell is accused of assaults against Ms McGuire, breach of the peace and following her. He denies the charges.

The witness, speaking via a video link, said: "He pulled her finger and bent it right back and it went purple, yellow and all black. A couple of days later my mum was in hospital. It made me really worried as I was with him and I was a bit scared at night."

The primary six pupil, who was wearing her school uniform, said she had been performing a dance routine with other girls from her dance class at the event.

She had been there with her mother, her younger sister Daisy and brother Oliver, who was in his pram.

Millie said: "I was in a dance club and one time it was really rainy so we had to go home. We went up the road, Derek came running up the hill.

"He was being really, like, strange and he asked mummy if he could have the car keys."

She told the court her mother was concerned because Mr Mitchell had been drinking and refused to give him the keys in case he hurt himself or other people.

She added: "Mummy was scared, she tried to run away. My sister was young and she was screaming, 'Give him the keys, give him the keys.' He was just hurting mummy.

"I was holding on to the pram, mummy wasn't holding on because she got such a fright. Daisy didn't understand what was going on and I didn't either. I knew he was hurting my mum and I wanted to do something about it but I was too scared and I knew I was too young to say anything."

Millie said Ms McGuire was about to cry because she had been "really hurt" but did not want to because it would make her children sad. Instead she told them, she would be "okay", the child witness said.

She added: "Derek was really angry, he was acting really strange. His eyes looked angry."

Millie told the court she referred to Mr Mitchell as "Dada." She added that the former Clyde One drivetime presenter's keys were in her handbag, which was hanging from her son's pram.

She added: "I think he thought they were in my mum's hand and tried to grab them and that's why he pulled her finger back, but they weren't there."

Millie said the incident happened in street in Eaglesham near their home. She said they went into the property, before Mr Mitchell came into house and was angry at Ms McGuire.

Millie added: "We just stayed in because it was really wet. I didn't tell anyone what had happened because I was scared in case he'd get into trouble for it and I didn't want that to happen.

"Nobody else saw, nobody else was there."

She told the court that Ms McGuire's finger was bandaged after she attended hospital.

Daisy, eight, also told the court that Mr Mitchell had pulled back her mother's finger.

Constable Colin Walker told the court he investigated claims Mr Mitchell had bitten Ms McGuire on the cheek and throttled her in Glasgow on Christmas Eve 2009.

Mr Mitchell was taken to a police station in handcuffs wearing only boxer shorts. Constable Walker said Ms McGuire said he had grabbed her throat and bitten her cheek. The officer told the court there were no marks on her cheek and she refused medical attention. She also refused to make a formal statement and had wanted Mr Mitchell to be warned.

The trial continues.
