A SCOTS kitchen firm is facing the possibility of being dragged through the courts after reportedly failing to pay a £90,000 fine for making nuisance calls to households.

DM Design was the first UK firm to be fined for cold-calling earlier this year.

Almost 2000 complaints were made to the Information Commissioner's Office (ICO) and the Telephone Preference Service (TPS) after the company consistently failed to check if individuals had opted out of receiving marketing calls.

DM Design – owned by businesswoman Donnie MacLeod – was given 28 days to pay the fine but is thought to have failed to do so.

The ICO is now applying to take the company, based in Cumbernauld, North Lanarkshire, to the High Court.

David Hickson, of the Fair Telecoms Campaign, reportedly said: "As well as a stiff monetary bill for breaking the rules, what this fine signalled was firms couldn't get away with making people's lives unbearable.

"For this company simply to ignore this judgment is pathetic. If this is the way they treat the authorities you can only wonder how they treat their customers."

DM Design made thousands of unwanted marketing calls over 18 months.

A spokesman from the ICO said: "At present we have not received any payment from DM Design. We will take steps to see that they pay and if it comes to it we will take appropriate court action."

DM Design could not be reached for comment.
