A KICKBOXER who sexually assaulted a teenage model is to have his case reviewed at the High Court in an appeal over his sentence.
Paul Collins was convicted of assaulting the 16-year-old with intent to rape her and was sentenced to five years in prison at Hamilton Sheriff Court in September 2010.
He was also sentenced to a five-year supervisory order on his release.
However, the Scottish Criminal Cases Review Commission (SCCRC), the body that investigates possible miscarriages of justice, has now referred the case back to the court.
In a statement, the SCCRC said: "The Commission has decided to refer the case to the High Court because it considers that there may have been a miscarriage of justice in respect of sentence.
"It considers also that it is in the interests of justice that his case be referred to the High Court for determination."
Collins, of East Kilbride, who was 38 at the time of the original court case, was found guilty of attacking the woman – who cannot be named for legal reasons – in the St Leonards area of East Kilbride in March 2009.
The court heard he lay in wait for his victim before grabbing her and pinning her to the ground as he said "sorry darling". He then subjected the teenager to a horrifying ordeal before she managed to break free.
