THE husband of lottery presenter Carol Smillie was taken to an industrial tribunal yesterday by the former manager of one of his restaurants, claiming he was owed more than two weeks' wages and holiday pay.

However, the hearing was postponed when Mr Alex Knight, proprietor of the Dolls House Restaurant in St Andrews was told by the tribunal chairman to go away and get advice on the matter.

Mr Mark Robertson, 24, of Westfields, Bishopbriggs, Glasgow, took his former employer to a tribunal under the Wages Act claiming he had not been paid for hours worked as manager of the restaurant in Church Square between June 1 and 17 when he was dismissed.

Mr Knight argued Mr Robertson owed him several hundred pounds when he was sacked. He told the tribunal it was a matter of admission Mr Robertson worked these dates but added: ''I don't believe the wages are due. I mean that he had been lent money over a period of about a month beforehand.''

Chairman Len Murray told him: ''Unless you have written consent from an employee you are not entitled to deduct from his wages. Can I suggest that we continue this application for four weeks and you find out your legal position Mr Knight because I am in no doubt what it is.''

Mr Robertson, who claimed he had paid back the borrowed money, was claiming #363 in unpaid wages and a further #148 holiday pay.
